Employment
We offer a wide ranging employment law service to both employers and employees and have extensive experience in advisory, transactional and litigation work in this area.
The responsibilities placed on employers are now considerable and the risk of legal consequences from a breach of law or good practice is ever present. As a result, the support of experienced and knowledgeable solicitors with specialist skills in employment law is indispensable.
When senior employees leave their employment, whether by agreement or following dismissal, both employer and employee will be concerned to ensure that their legal positions are fully protected. Employers will wish to protect confidential information, to prevent unfair competition and to prevent unlawful poaching of their clients. Employees will wish to ensure that they receive their full legal exit payment and that their future employment is not restricted by unduly onerous restrictive covenants.
Our work in this area includes:
- Drafting and reviewing terms and conditions of employment, employment handbooks and executive service agreements
- Advising employers on dismissal, disciplinary and grievance procedures
- Advising upon handling redundancies
- Advising upon implementing equal opportunities and family friendly policies
- Advising employees upon contracts and disciplinary and dismissal situations
- TUPE issues
- Acting for both employers and employees on tribunal claims and appeals
- Advising on the enforcement of confidentiality clauses, restrictive covenants, etc
- Seeking injunctions to prevent the misuse of confidential information
and breaches of restrictive covenants by existing employees
